GENERAL
This agreement is between the person signing it as the hirer and/or on whose behalf it is signed (“I”, “Me”, of “My”) and the company whose name appears at the top of this agreement (“You” or “Your”). I understand that in no event will I be deemed to be your agent, servant or employee in any manner for any purpose whatsoever. I agree that you do not waive any rights under this agreement. I agree that no variation to this agreement will be accepted.
MEANING OF VEHICLE
The word “vehicle” means the vehicle provided and includes tyres, tools, equipment and accessories.
AUTHORISED DRIVERS AND AGE
I confirm that I have an unendorsed and valid drivers licence and am older than 25 years. I agree that you have the right to verify that my licence has been validly issued and that you may refuse to provide a vehicle to me if my licence has been suspended, revoked or restricted in any way. ALL OTHER DRIVERS ARE UNAUTHORISED. I agree not to allow unauthorised persons to take possession of the vehicle and/or its keys.
VEHICLE RETURN
I agree to return the vehicle to you in the same condition as received, except for ordinary wear and tear, on the due time and at the place specified by me or sooner on your demand.
REPOSSESSING THE VEHCILE
You can repossess the vehicle anytime if it is found illegally parked, being used to violate the law and/or the terms and conditions of this agreement, or appears to be abandoned. You can also repossess the vehicle anytime you discover I made a misrepresentation to obtain the vehicle. You need not notify me in advance.
PROHIBITED USE OF THE VEHCILE
I will use the vehicle with due care at all times and will follow your instructions and will obey all the laws of the UK. I will not allow any use of the vehicle to tow or push anything. I will not allow its use for any illegal purpose or by any person under the influence of intoxicants, narcotics or with impaired faculties. I will not allow it in any test, race or other contest.
A violation of this clause automatically ends the hire of the vehicle.
PASSENGERS
If you choose to take a passenger on the vehicle that passenger is carried entirely at your responsibility. At no time are you permitted to allow the passenger to take possession of the vehicle and/or its keys.
ACCIDENTS
If you have an accident while using the vehicle neither you nor your passenger are covered by insurance for any injuries caused. I provide helmets and water proof clothing for hire and helmets must be worn at all times.
DAMAGE and LOSS WAIVERS – DECLINED
I understand that if I do not accept these waivers, I will pay for all loss or damage to the vehicle regardless of fault, whether due to theft, collision, vandalism or any other cause. If the vehicle is stolen or determined by you to be damaged beyond repair, I will pay its replacement value. In the case of the vehicle being damaged beyond repair, I accept that this amount will be further reduced by any amount accepted by you for the remains of the damaged vehicle.
PAYMENT
I agree to pay on demand all charges resulting from my use of the vehicle. I will pay any collection costs – including your legal fees if I do not pay any amount when due. I will pay all fines, court costs and other expenses for violations with respect to the use of the vehicle while in my possession.
INFORMATION SHEET
I confirm that I have been handed the Information and Safety Sheet relating to Quad Biking. I have read and understood the Information and Safety Sheet.
